Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the 30-Day Trials mobile application (the “App”) and the https://nishcoapps.com (the “Website”) published by Nishco Ltd (“us”, “we”, or “our”).
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the App.
By accessing or using the App you agree to be bound by these Terms. If you disagree with any part of the terms then you may not use the App.
Disclaimer of Warranties
You understand and expressly agree that use of the App is at your sole risk. the App is provided on an “as is” and “as available” basis. Nishco Ltd expressly disclaims all warranties of any kind, whether express or implied, with respect to the App (including, but not limited to, the implied warranties of merchantability, fitness for a particular use or purpose, and non-infringement). Nishco Ltd makes no warranty that the App will meet your requirements, or that the App will provide a service that is uninterrupted, timely, secure, or error free. No advice or information, whether oral or written, obtained by you from Nishco Ltd or through the App shall create any warranty not expressly made herein.
Limitation of Liability
Nothing in these terms, including this section, shall limit Nishco Ltd’s liability for losses which may not be lawfully limited by applicable law.
You expressly understand and agree that Nishco Ltd shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. this shall include, but not be limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, cost of procurement of substitute goods or services, or other intangible loss.
The limitations on Nishco Ltd’s liability to you in the paragraph above shall apply whether or not Nishco Ltd has been advised of or should have been aware of the possibility of any such losses arising.
Indemnity
You agree to hold harmless and indemnify Nishco Ltd, and its affiliates, employees or partners from and against any third party claim arising from or in any way related to (a) your breach of the Terms, (b) your use of the Service, (c) your violation of applicable laws, rules or regulations in connection with the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. In such a case, Nishco Ltd will provide you with written notice of such claim, suit or action.
Pricing Terms
Some parts of the Service are only available to paying customers.
Payment will be charged to your iTunes account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Account will be charged for renewal within 24 hours prior to the end of the current period.
Subscriptions may be managed by the user and auto-renewal may be turned off by going to the users Account Settings after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication where applicable.
Intellectual Property
The App and the Website and all of the original content contained therein are the sole property of Nishco Ltd and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by Nishco Ltd.
Nishco Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Nishco Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
Changes to These Terms
Nishco Ltd reserves the right to modify these Terms at any time.
Therefore, we ask that you check and review these Terms for such changes in the App or on the Website on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access both the App and the Website immediately.
Your decision to continue to visit and make use of the App or the Website after such changes have been made constitutes your formal acceptance of the new Terms.
